2b. What is not Copyrighted?

Works that are not "fixed in a tangible medium," such as:
  • Impromptu speeches
  • Singing in the shower
  • Choreography that has not been notated or filmed
Impromptu speech
Factual and commonly-known information:
  • Weights and measures
  • Addresses
  • Dates
Addresses in a telephone book
Ideas, concepts, slogans, and inventions - although some of these are protected by patents or trademarks
No smoking concept
Works in the public domain:
  • Works published before 1923 in the United States
  • Works for which the copyright term has expired without renewal
  • Works the author has intentionally placed in the public domain
  • Works that are products of the U. S. government
Emma by Jane Austen published before 1923
